snas.app Terms & Conditions
These Terms & Conditions (“Agreement”) govern your access to and use of the Snas.app software-as-a-service platform (“Service”), provided by Snas.app (“we”, “us”, “our”). By registering for an account, purchasing a subscription, or using the Service, you agree to be bound by these terms.
1. Subscriptions & Billing in Advance
-
Billing Cycle: All subscriptions are billed in advance on a monthly recurring basis via our payment gateway.
-
Taxes & Pricing: Fees are exclusive of applicable taxes unless stated otherwise. We reserve the right to change our pricing upon giving reasonable prior notice to active subscribers.
-
Payment Failures: If a payment fails or an invoice is overdue, we reserve the right to suspend or restrict access to your account until outstanding balances are cleared.
2. Cancellation at Any Time
-
Self-Service Cancellation: You may cancel your subscription at any time directly through your account dashboard or by contacting support.
-
No Refunds for Partial Months: Cancellation takes effect at the end of your current paid billing period. We do not provide refunds or credits for partially used subscription periods or unused monthly broadcast allowances.
3. Account Usage, Fair Use & Responsibilities
-
Strict Opt-In & Mailing List Rules: All mailing lists and email addresses used within the Service must be strictly opt-in. You are explicitly prohibited from uploading, importing, or mailing to lists that have been bought, rented, leased, scraped, harvested, or otherwise acquired from third-party sources without explicit, verifiable subscriber consent.
-
Fair Use & Unforeseen Misuse: The Service is designed as a lightweight newsletter and broadcast tool for standard business or personal use. You agree not to misuse the platform or stress system infrastructure in ways outside its intended scope. This includes, but is not limited to, maintaining unreasonable subscriber-to-limit ratios, creating an excessive or disproportionate number of lists/segments, automating high-frequency queries that strain system resources, or utilizing the platform for unintended use cases. We reserve the right to evaluate usage patterns and restrict, suspend, or require plan upgrades for accounts that place an unreasonable burden on our infrastructure.
-
Lawful Use & Compliance: You are solely responsible for your account activity, campaign content, and compliance with GDPR, spam regulations, and applicable data protection laws.
-
Acceptable Use Policy (AUP): You agree not to use the Service for illegal activities, spamming, distributing malware, or violating the rights of others. We reserve the right to immediately suspend or terminate accounts that breach our AUP or upstream provider policies.
-
Subscriber Data: All subscriber data and lists remain your property. Upon termination, you may export your data. Data will be purged from our active systems following a standard retention window post-termination, unless retained for legal or accounting compliance.
4. Service Availability & Performance
-
No Guarantee of Continuous Availability: We will use reasonable commercial efforts to maintain the availability of the Service, but we cannot guarantee continuous, uninterrupted, or error-free service.
-
Maintenance & Downtime: We reserve the right to temporarily suspend the Service for routine maintenance, security updates, emergency patches, or technical issues without prior notice.
5. External Dependencies: AI & SMTP Services
-
External Providers: The Service relies on third-party infrastructure, including external SMTP delivery networks and Artificial Intelligence (AI) providers, which are entirely beyond our direct control.
-
AI Limitations: AI-powered features (such as content polishing or generation) are supplied on a best-endeavours basis. AI models may occasionally produce inaccurate or unexpected outputs; you remain solely responsible for reviewing and approving all messages before sending.
-
Third-Party Failures: We shall not be held liable for delivery failures, inbox placement rates, API outages, throttling, or disruptions caused by third-party email routing, hosting platforms, or AI services.
6. Intellectual Property & Branding
-
Software Ownership: Snas.app, its source code, design, logos, and underlying technology remain the exclusive property of Snas.app.
-
Platform Branding: Depending on your subscription tier, outgoing communications or default footers may include a subtle “Powered by Snas.app” attribution link, unless an explicit white-label option is selected.
7. Termination
-
Termination by You: You may stop using and terminate your account at any time by cancelling your subscription.
-
Termination by Us (End of Billing Cycle): We reserve the right to terminate your account or decline to renew your subscription at the end of your current 30-day billing cycle by providing reasonable notice.
-
Immediate Termination by Us: We may suspend or terminate your account immediately if you breach these terms, engage in fraudulent or unlawful activity, violate our fair use policies, use prohibited/non-compliant lists, or if required to do so by law or our upstream infrastructure providers.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Snas.app’s total aggregate liability arising out of or relating to your use of the Service shall be strictly limited to the total fees actually paid by you to us in the three (3) months immediately preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
9. Indemnity
You agree to indemnify, defend, and hold harmless Snas.app, its operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these terms, your content, your mailing lists, or your violation of any laws or third-party rights.
10. Force Majeure
We shall not be liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to internet outages, telecommunication failures, cyber attacks, third-party provider disruptions, utility failures, acts of government, natural disasters, civil unrest, or other force majeure events.
11. Changes to Terms
We reserve the right to modify or update these Terms & Conditions at any time. Material changes will be notified via the platform or email. Continued use of the Service after changes take effect constitutes your acceptance of the revised terms.
12. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of Ireland or the United Kingdom (depending on your primary billing jurisdiction). Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the respective courts.
